The Terms of Use ("Terms of Use") form an agreement between licensed mental health professionals/clients (hereinafter referred to as "you") and Aware AI Technologies Private Limited (together with affiliates referred to as "TheAware.AI", "company", "we", "our" or "us"). These Terms of Use apply to your use of services associated with mobile application and website designed for our product Mirror, hosted at https://theaware.ai dedicated to individual's personal growth and overall emotional well-being (hereinafter referred to as "Services").
These Terms of Use include our Service terms and important provisions for resolving disputes through arbitration. By using our Services, you agree to these Terms of Use.
Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.
Who We Are
TheAware.AI is a company dedicated to enable personal growth and emotional well-being by connecting you with mental health professionals. These Terms of Use govern your use of the Services.
Services means the personalized journaling and mental health support services provided by TheAware.AI through the mobile application for clients and the website portal for licensed mental health professionals, including features such as generative AI, AI Chatbot, encrypted journaling, templates, reminders, and secured communications with professionals.
Registration and Access
Minimum age: You must be at least 13 years old. If you are under 18 you must have your parent or legal guardian's permission to use the Services.
Registration: Licensed mental health professionals can create an account on the website portal and clients can create an account on the mobile application.
For the mobile application, you must sign in using a valid Google or Apple account.
Professionals accessing the website portal must provide a valid email and verify their licensed credentials.
You may not share your account credentials or make your account available to anyone else. You are responsible for all activities that occur under your account.
Using Our Services
What you can do: Subject to your compliance with these Terms of Use, you may access and use our Services.
You must comply with all applicable laws and guidelines we provide.
What you cannot do: You may not use our Services for illegal, harmful, or abusive activity.
You may not copy, reverse engineer, extract data, or misuse outputs.
Software: Our Services may include downloadable software that updates automatically.
Use of AI: AI is used for journaling prompts and chatbot support. Your data is not used to train AI models.
The chatbot is not a replacement for professional mental health services.
Generative AI Output: Third-party tools may be used and their terms apply.
Feedback: We may use your feedback without compensation.
Our IP Rights
We own all rights, title, and interest in and to the Services.
Paid Accounts
Billing: Subscription-based model with secure payment processing.
You can manage billing inside the app.
Subscriptions auto-renew until cancelled.
Cancellation: Effective at end of billing cycle.
Payments are non-refundable except where required by law.
Price changes will be notified 30 days in advance.
Termination and Suspension
You may stop using the Services anytime.
We may suspend or terminate accounts if terms are violated or risks arise.
Inactive accounts may be removed after one year.
Appeals
If you believe action was taken in error, email mirror@theaware.ai.
Discontinuation of Services
We may discontinue services with prior notice and refunds for unused periods.
Disclaimer of Warranties
Services are provided "as is" without warranties.
Limitation of Liability
We are not liable for indirect or consequential damages.
Liability is limited to the amount paid in the last 12 months.
Dispute Resolution
Disputes will be resolved via arbitration under Indian law.
Proceedings will be held in Delhi, India.
No class action claims allowed.
General Terms
We may update terms with notice.
These terms are governed by Indian law.
Courts in West Bengal have jurisdiction.
